Operator and Licence

These Terms and Conditions govern your use of the robwaterhouce wagering services and website.

robwaterhouce is operated by Tarpin Finance Pty Limited (ABN 84 622 556 423, ACN 622 556 423), Suite 1, 185 Gloucester Street, The Rocks, New South Wales 2000, Australia.

Wagering services made available through robwaterhouce are provided under Licence No. 3297/2023/WB, held by Robert Waterhouse. The licence is regulated by Liquor & Gaming NSW in New South Wales, Australia.

By registering for an account or using the wagering services, you agree to be bound by these Terms and Conditions.

Introduction

These Terms govern your use of robwaterhouce wagering services. By creating an account you agree to be bound by these Terms. robwaterhouce is operated by Tarpin Finance Pty Limited (ABN 84 622 556 423, ACN 622 556 423). The wagering licence, No. 3297/2023/WB, is held by Robert Waterhouse and regulated by Liquor & Gaming NSW.

Please read these Terms carefully. If you do not agree with them, do not register for an account or use the Services.

Definitions

'Account' means your robwaterhouce wagering account. 'Services' means wagering services on the platform. 'We/us/our' refers to Tarpin Finance Pty Limited, the operator of the platform. 'Licence Holder' means Robert Waterhouse, the holder of Licence No. 3297/2023/WB regulated by Liquor & Gaming NSW. 'You/your' refers to the account holder. 'Platform' means the robwaterhouce website. 'Bet/Wager' means a bet placed through Services. 'Event' means any event on which wagering is offered.

'Betting Rules' means the general betting rules, sport-, racing- and market-specific rules published on the Platform. 'Promotional Terms' means the specific terms that apply to a promotion. 'Responsible Gambling Policy' means the Responsible Gambling information published on the Platform. 'Withdrawable Balance' means cleared funds in your Account that are not subject to a pending bet, a promotional condition, a verification hold or a lawful restriction.

Betting Rules and Order of Precedence

These Terms should be read together with any applicable Betting Rules, market rules, Promotional Terms, the Responsible Gambling Policy, the Privacy Policy, the Cookie Policy, the Deposit Limits Policy and any other rules made available through the Platform. Each of those documents forms part of the agreement between you and us.

If there is any inconsistency between these documents, the following order of precedence applies, with the earlier document prevailing to the extent of the inconsistency:

  • Any requirement of applicable law or a direction of Liquor & Gaming NSW;
  • Promotional Terms, but only in relation to the promotion they govern;
  • Sport-, racing- or market-specific Betting Rules, in relation to the bets they govern;
  • The general Betting Rules;
  • These Terms;
  • The Responsible Gambling Policy, Privacy Policy, Cookie Policy and Deposit Limits Policy.

Eligibility

Must be 18+ years. Must be in a lawful jurisdiction. Must not be excluded via BetStop. Must provide accurate identification. We may verify identity at any time.

Account Registration and Verification

To use the Services you must register an Account with your full name, date of birth, residential address, email address and contact details. All information you provide must be accurate, complete and current, and you must update it promptly if it changes. Registration is available only to individuals acting on their own behalf.

  • One Account per person. You may hold only one Account, and an Account may not be opened, held or used for the benefit of any other person or entity.
  • No registration on behalf of others. You may not register an Account in the name of, or using the details of, another person.
  • Identity and age verification. Before you can wager or withdraw, we must verify your identity and that you are 18 years or older. Verification may use the details you provide, government-issued identification and independent data sources, and we may request additional documents at any time.
  • If verification cannot be completed, we may restrict your Account to prevent deposits, wagering or withdrawals, and may close it. Any Withdrawable Balance will be returned to you once your identity has been confirmed, subject to applicable law.
  • Credentials. You are responsible for keeping your login details confidential and for all activity on your Account. Do not allow anyone else to use your Account. Notify us immediately of any suspected unauthorised use.
  • Closing your Account. You may close your Account at any time through the account closure process available to you or by contacting customer support; see section 15. We do not place unreasonable obstacles in the way of account closure.

Deposits and Withdrawals

Approved deposit methods: Visa and Mastercard debit cards, Apple Pay, Google Pay and PayID. Credit cards and credit-linked payment services are not accepted. Minimum and maximum deposit amounts may apply and are shown at the point of deposit.

  • Own payment method only. Deposits must be made from a payment method held in your own name. Payments from third parties, including cards or accounts belonging to another person, are not accepted and may be returned.
  • Cleared funds. Funds are available for wagering only once they have cleared. We may reverse a credit if a deposit is declined, charged back or found to be fraudulent.
  • Withdrawals. Withdrawals are paid only to a verified payment method or bank account in your name, and where possible to the method used to deposit. Identity verification must be complete before a withdrawal is processed.
  • Processing times. We aim to process withdrawal requests within 1–3 business days. The time for funds to reach you depends on your bank or payment provider.
  • Fraud and AML review. We may delay, withhold or decline a deposit or withdrawal while we complete a fraud, anti-money-laundering or counter-terrorism-financing review, or where required by law or by a direction of a regulator or law enforcement agency.
  • Remaining balance. On closure or restriction of your Account, any Withdrawable Balance will be returned to you, subject to identity verification, applicable law and any legitimate investigation or restriction.

Placing Bets

All bets are subject to these Terms, the Betting Rules and any event- or market-specific rules. You are responsible for checking the details of a bet before confirming it.

  • Acceptance. A bet is accepted only when it has been received and recorded by our system and a confirmation is shown in your Account. Until then no contract exists. Bets are placed at your own risk.
  • Connection and system failure. If a bet is not recorded by our system because of a loss of connection, device failure or a system outage, it is not accepted. Bets that are recorded before the outage stand.
  • No changes after acceptance. Once accepted, a bet cannot be changed or cancelled by you.
  • Stakes and limits. Minimum and maximum stakes apply and are displayed at the point of bet. We may set individual betting limits on any Account, market or event, and may decline or partly accept any bet at our discretion.
  • Odds. Odds may change at any time before acceptance. The odds shown in your confirmation are the odds at which the bet was accepted.
  • Palpable or manifest errors. Where a bet is accepted at odds, a line or a price that is clearly incorrect because of a technical, human or pricing error, the bet may be settled at the correct odds or voided in accordance with the Betting Rules.
  • Duplicate bets. Where an identical bet is received more than once in error, we may treat the additional bets as duplicates and void them.
  • Late bets. robwaterhouce offers pre-match markets only. A bet placed after the start of an event or after a market has closed will be void.
  • Void or cancelled bets. The circumstances in which we may void or cancel a bet are set out in section 09.

Results and Settlements

Bets will be settled using the official result published by the relevant governing body or other recognised official source. Settlement may be adjusted where an official result is corrected, amended or subject to a protest or inquiry, in accordance with the applicable Betting Rules.

We make reasonable efforts to settle bets promptly. Settlement may be delayed while a protest, inquiry or stewards' decision is pending. Dead heat rules apply as set out in the Betting Rules. If you believe a bet has been settled incorrectly, you may lodge a complaint under section 17.

Cancellation and Voiding

We may cancel or void a bet, and where a bet has been settled, reverse the settlement and adjust your balance, where:

  • the bet was accepted at obvious or manifest incorrect odds, or with incorrect market information, participants or event details;
  • the market was offered in error, is a duplicate of another market, or was left open because of a technical malfunction;
  • the bet was placed after the event had started or after the market had closed (late bet);
  • the event is abandoned, cancelled or postponed and is not completed within the period set out in the Betting Rules;
  • the event is rescheduled or its venue changes in a way that materially alters the market, as set out in the Betting Rules;
  • a selection is a non-runner or is withdrawn before the start, in which case the bet on that selection is void and refunded, and multi bets are recalculated;
  • a dead heat or other special result applies, in which case the dead heat rules in the Betting Rules determine the payout;
  • there is evidence of fraud, collusion, match fixing, money laundering or other breach of these Terms or the Betting Rules;
  • we are required to do so by law, by a court order or by a direction of Liquor & Gaming NSW or another authority.

Where a bet is voided, the stake is returned to your Account. Where a bet is settled in error, we may correct the settlement and recover any amount overpaid.

Responsible Gambling

Our Responsible Gambling Policy forms part of these Terms and explains the responsible gambling tools and support services available to customers, including deposit limits, activity reminders, time-out, self-exclusion and access to BetStop, the National Self-Exclusion Register. We encourage you to use these tools. Free and confidential support is available from Gambling Help Online on 1800 858 858.

Self-exclusion. If you self-exclude through BetStop or through us, your Account will be closed or suspended for the exclusion period, you will not be able to deposit or place bets, you will be removed from marketing communications, and any Withdrawable Balance will be returned to you. Bets placed before the exclusion took effect stand and are settled normally. We will not knowingly accept a bet from a self-excluded person, and any bet accepted in error may be voided.

Promotions and Bonus Offers

robwaterhouce may from time to time make promotional offers available to eligible existing account holders where permitted by applicable law. Any promotion will be subject to specific terms and conditions, eligibility requirements, validity periods and any applicable wagering or withdrawal conditions.

Promotional offers are not guaranteed and do not form an ongoing entitlement. robwaterhouce may modify, suspend or withdraw a promotion where permitted by law and in accordance with the applicable promotional terms.

robwaterhouce does not offer or advertise inducements to open a betting account where prohibited by applicable law. Promotional communications will only be provided in accordance with applicable wagering, advertising and direct marketing requirements, and only to customers who have consented to receive them. You can withdraw that consent at any time through your Account settings or by contacting us.

Intellectual Property

All platform content is property of Tarpin Finance Pty Limited or licensors, protected by copyright. No reproduction without written consent.

Privacy

Personal information handled per Privacy Policy which forms part of Terms. Use of Services constitutes consent.

Prohibited Conduct

You must not use the Platform or the Services for any unlawful purpose or in any way that could damage the integrity of the Services. In particular, you must not:

  • open or operate more than one Account, or use an Account held by another person;
  • register or wager under a false identity, or provide false, incomplete or misleading information;
  • use a payment instrument that belongs to another person, or engage in fraudulent payment activity;
  • raise a chargeback or payment dispute in bad faith, or otherwise abuse the chargeback process;
  • collude with other customers, engage in or facilitate match fixing, or wager on an event whose outcome you can influence or have inside knowledge of;
  • manipulate markets or prices, or attempt to do so;
  • access the Platform with bots, scripts or other automated means, or scrape its content where prohibited;
  • exploit a software, pricing or settlement error, or fail to report one you have identified;
  • circumvent or attempt to circumvent any Account restriction, betting limit or responsible gambling control, including self-exclusion;
  • interfere with the security or operation of the Platform, or introduce malicious code.

A breach of this section may result in bets being voided, winnings being withheld, your Account being suspended or closed, and the matter being reported to the relevant authorities.

Suspension and Closure

Closure by you. You may request closure of your Account at any time through the available account closure process or by contacting customer support. Subject to identity verification, applicable law and any legitimate investigation or restriction, any remaining withdrawable balance will be returned to you. Account closure is separate from self-exclusion through BetStop; if you want to be excluded from all licensed Australian wagering services, register with BetStop.

Suspension or closure by us. We may suspend or close your Account where you breach these Terms or the Betting Rules, provide false information, fail verification, are or become self-excluded, where we suspect fraud, collusion or money laundering, or where we are required to do so by law or by a direction of Liquor & Gaming NSW. We will tell you the reason unless we are prevented from doing so by law. Any Withdrawable Balance will be returned to you subject to verification, applicable law and any legitimate investigation.

Limitation of Liability

Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded or limited under applicable Australian law, including the Australian Consumer Law. Where our liability for a breach of such a guarantee can be limited, it is limited, at our option, to supplying the Services again or paying the cost of having them supplied again.

Subject to the paragraph above, and to the extent permitted by law: our total liability to you in connection with a bet is limited to the amount of the stake and any winnings due on that bet, and in connection with your Account otherwise to the balance of your Account at the time the relevant event occurred; and we are not liable for indirect or consequential loss, loss of profit, revenue or data, or for loss caused by a Force Majeure event, by your breach of these Terms or by the failure of your device or internet connection.

Disputes and Complaints

If you have a complaint about your Account, a bet, a settlement or any aspect of the Services, contact us first. We will investigate and respond reasonably. The process is:

  • How to submit. Send your complaint through the Contact Us page or by email to support@robwaterhouce.com, selecting the enquiry type that best matches your issue.
  • Information required. Include your Account details (name and registered email), a description of the issue, the relevant bet or transaction details (date, event, selection, stake and any reference) and any supporting information.
  • Acknowledgement. We acknowledge complaints, with a reference number, within 2 business days.
  • Investigation. We investigate the complaint, which may involve reviewing bet, transaction and Account records, and may ask you for further information.
  • Response. We aim to provide a written response within 10 business days. If we need more time we will tell you why and when to expect a response.
  • Escalation. If you are not satisfied with our response, you may refer the complaint to Liquor & Gaming NSW (liquorandgaming.nsw.gov.au). Nothing in these Terms limits your right to make a complaint to a regulator or to seek a remedy under applicable law.

Changes to Terms

We may amend these Terms from time to time, including to reflect changes in law, regulatory requirements, our Services or the Betting Rules. The current version is always published on the Platform at /terms-and-conditions, with the effective date shown at the top of the page.

Changes take effect on the effective date shown in the updated version. Material changes will be notified to registered customers by email to the address on the Account or by a notice on the Platform before they take effect. Bets accepted before a change takes effect are governed by the Terms in force when the bet was accepted. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms; if you do not agree, cease use and close your Account under section 15.

Tax

You are responsible for tax on winnings. We may report to tax authorities as required.

Force Majeure

Not liable for failures beyond reasonable control including natural disasters, war, pandemic, government actions, power/internet failures, industrial disputes.

Governing Law

Governed by laws of New South Wales. Non-exclusive jurisdiction of NSW courts.

Severability

Invalid provisions severed; remaining provisions continue in force.

Entire Agreement

These Terms, together with the Betting Rules, any Promotional Terms, the Responsible Gambling Policy, the Privacy Policy, the Cookie Policy, the Deposit Limits Policy and the other rules referenced in section 03, constitute the entire agreement between you and us in relation to the Services.

Assignment

We may assign rights without consent. You may not assign without written consent.

Waiver

Failure to exercise rights does not constitute waiver.
